Le Meridien Faces The Legal Repercussion For Infringing Music Copyright Laws.

The New Year celebrations turned out not-too-merry for the Delhi based five-star hotel, Le Me-ridien. They have been restrained by way of Injunction from utilizing the Sound Recordings of Novex until further court orders. Basically, the luxury hotel had organised and managed various events, including ‘New Year’s Eve held on 31st December’17, for entertaining their guests/viewers. During these occasions, they had played sound recordings in the background in their banquets, res-taurants, and live events.

This injunction order was passed by Hon’ble High Court at Delhi, on 16th January 2018 for restrain-ing further infringement of Copyrights (case No.: CS(COMM) 37/2018 & IA No.818/2018 (u/O XXXIX R-1&2 CPC).

In response to the legal proceedings, Le Meridien has claimed to have ‘erroneously interpreted’ the Copyright Act as a reason for failing to secure Non-Exclusive Public Performance Rights in Sound Recordings for commercial entertainment purposes.

As seen in the past, our Hon’ble Courts across India have been very pleased to grant an order of in-junction in favour of Novex Communications retraining the event organisers/hotels/ stadiums etc. from playing the repertoire of songs without obtaining permissions. Such strong rulings of the Courts have helped Music industry, Entertainment industry, and the copyright owners get their due royalty. It is high time that the hospitality industry patrons take Copyright laws seriously. For saving a small amount in purchasing rights, they can end up with years of legal battles, bad press, and dis-satisfied customers.
